New GST Rule 14B: How Online Sellers Can Expand Across States with GST Compliance

| |

The e-commerce business in India provides a lot of scope to small businesses. But the sale across states may require GST registration by the e-sellers as well. To overcome this problem, the Indian Government has come up with a new rule, GST Rule 14B for Online Sellers, applicable from 1 November 2026. It will allow the eligible sellers to register in other states without having to open their physical office in those states. This will help cut down on costs while conducting business in other states.

What Is GST Rule 14B for Online Sellers?

Through notification no.05/2026-Central Tax, dated 26 October 2026 the government has issued Rule 14B that provides eligibility to the sellers to use the e-commerce operator’s warehouse as their Principal Place of Business (PPoB) in another state.

Earlier the sellers had to maintain separate business premises in order to get GST registration in each state. But with the help of approved marketplace warehouses, the need for separate business places can be avoided. The main purpose of GST Rule 14B for Online Sellers is to make it easy for small businesses to expand to other states without much infrastructure costs.

Who Is Eligible Under the New Rule?

There are certain criteria the seller has to fulfil; hence it is not available to everyone.

  1. Sellers should have regular GST registration in their home state with the same PAN.
  2. Sellers should make supply through e-commerce operators which collect TCS as per section 52 of CGST Act.
  3. Monthly tax liability on supply to registered buyers (not with the same PAN) should not exceed 2.5 Lacs in one month.
  4. E-commerce operators should agree to use its warehouse as your declared business address.
  5. Sellers should not have physical business presence in the destination state.

Note: 2.5L is on tax not your monthly turnover.

How Does GST Registration for Online Sellers Work?

The new rule makes the application process easier. If you meet the seller criteria you can follow these steps,

Step1: Submitting application on GST portal, by filing GST REG-01.
Step2: If Registered then fill GSTIN of the State of domicile.
Step3: Fill all other details and address of e-commerce warehouse.
Step4: Obtain approval within 7 Working Days for selling on Marketplace.
Step5: Complete Aadhaar based authentication.
Step6: Complete Verification of business premises located in the State of domicile.

Once the verification is successful, the GST portal assists to register electronically. The physical verification shall be completed by the Officer within 30 days from the date of generation of ARN, failing which the application shall be deemed to be approved, subject to successful Aadhaar authentication and document verification.

This process simplifies the GST Registration for Online Sellers and eliminates the need of separate commercial premises.

How Can Online Sellers Expand Across States?

Let’s say you are a seller of clothes based out of Delhi and you want to keep your products in the warehouse of a marketplace based out of Maharashtra. Earlier, the seller had to get separate business premises for getting Maharashtra GST registration.

The new rule permits the seller to designate the approved marketplace warehouse as the principal place of business. When the requirements are satisfied and the seller has finished the registration, the seller can carry out the eligible operations from the warehouse.

Advantages:

1.Low cost of operations: No need to rent extra office space for registrations.

2.Increased number of customers: Sale to customers from different states.

3.Logistics advantage: Warehouses in the marketplace will aid in storage and dispatches.

4.Scalability of business:It becomes easy for small businessmen to expand their business.

5.Easy to scale up: You do not need much infrastructure to conduct business in multiple states.

In essence, GST Rule 14B has opened up doors for small e-commerce businesses.

GST Compliance and GST Return Filing Requirements

Simplified registration does not mean the sellers are exempted from GST compliance. The sellers need to comply with their tax obligations. Some important aspects are:

1.Proper record maintenance: books of accounts along with the required documents need to be maintained at the head office of the home state.

2.GST Return Filing: Complete GST Return Filing along with tax payments on time.

3.Tax Liability Monitoring: Check whether it is crossing ₹2.5 lakh per month.

4.Marketplace Consent Maintenance: Receiving fresh consent whenever there is any change in details of warehouses.

5.Maintenance of Registration Details: Complete GST REG-14 form within 30 days if operator withdraws consent from declared warehouse.

The non-compliance of above aspects may cause problems in the registration of sellers.
