Abhishek Files ₹5,000 Cr Trademark Infringement Against Brother

Recently, the Bombay high court has admitted an interesting case related to trademark infringement. This case is a ₹5,000 crore lawsuit filed by Abhishek Lodha, the promoter of Macrotech Developers, against his younger brother, Abhinandan Lodha. The dispute is around the unauthorised use of the trademark ‘Lodha’. Both the brothers are sons of the Maharashtra Cabinet Minister.

Dispute Over ‘Lodha’ Trademark

Abhishek Lodha has informed the court that his company Macrotech Developers has trademark registration for the name ‘Lodha’ and its variations such as ‘Lodha Group’. He has alleged that the House of Abhinandan Lodha has used these trademarks without authorization, violating intellectual property rights.

History of Lodha Trademark Ownership

According to the complaint, the Lodha Group owns several registered trademarks under the ‘Lodha’ name. Until 2015, all companies under the Lodha family umbrella used the trademark. However, after Abhinandan separated from the Lodha Group to start his venture, the terms of trademark usage were revised in 2017.

Violation of Separation Agreement

As part of separation agreement, Abhindan had agreed to name his business ‘The House of Abhinandan Lodha’ and that they will not engage in real estate activities in specific regions for a set period. However, as per the claims of Macrotech, these terms have been violated.

Interim Relief Application filed by Macrotech

The lawsuit filed by Abhishek Lodha seeks damages amounting to ₹5,000 crore for alleged infringement of intellectual property rights. Furthermore, In an interim application, the company sought a perpetual injunction against the defendants from infringing its trademark “Lodha.” The Bombay Court is going to hear the application seeking interim relief on January 27, 2025.
