GST Registration Gets Easier, Unfair Tax Demands Restricted

| |

Starting a business in India means lots of paperwork. So,  your GST registration should not get held up by unnecessary document requests. Moreover, it is important that you are able to understand the tax notices on your own. As a result, recent clarifications from the Central Board of Indirect Taxes and Customs (CBIC) address these concerns.

What Is Getting Easier in GST Registration?

CBIC’s guidelines restrict unnecessary questions and document demands during the registration process now.

The main clarifications include:

  • Udyam certificates should not be demanded unnecessarily. An Udyam certificate should not become an additional condition for obtaining GST registration.
  • Working from home should not invite presumptive objections. Officers should not assume that your stated business activities cannot operate from the declared premises.
  • Unpaid utility bills alone should not cause rejection. An outstanding electricity or water bill should not automatically disqualify your application for registering under GST.

Important Note: You must still provide appropriate proof of your business address.

Will Your GST Registration Be Processed Within Seven Days?

Applications with successful Aadhaar authentication ordinarily have a seven-working-day processing period. However, this does not guarantee approval within a week for every applicant.

However, applications that require physical verification can follow a 30-day timeline. Furthermore, If an officer requests clarification through Form GST REG-03, you must reply through Form GST REG-04 within seven working days. The officer then has seven working days after receiving your reply to approve or reject the application, recording reasons for rejection.

GST Tax Demand Rules: Clear Reasons and Evidence Required

A tax notice should explain the department’s case clearly enough for you to respond as per the latest rules. The clarifications require notices and demands to identify:

  • The alleged violation and the period concerned.
  • The evidence supporting the allegation.
  • How the proposed tax, interest and penalties were calculated.

Furthermore, the demand amounts should be clearly quantified in notices, preferably financial year-wise.

A tax shortfall or reporting discrepancy does not, by itself, establish fraud.

Officers need material evidence before invoking provisions involving fraud, deliberate misstatement or suppression with intent to evade tax. Legitimate tax liabilities remain payable and the latest rules restrict unsupported allegations.
