Amazon Loses ₹340 Cr Case Over Trademark Infringement

Significant penalty for Amazon as it has been asked to pay Rs, 340 Crore for Trademark Infringement. The case was filed by Lifestyle Equities CV, the owner of the “Beverly Hills Polo Club” (BHPC) brand, against Amazon. They filed the trademark infringement case against amazon for selling products with a logo similar to BHPC’s trademark.

Lifestyle Equities CV claimed that Amazon was selling apparel under its private label “Symbol,” which had a logo similar to the BHPC brand.

As a result,  the similarity in the logos misled customers into thinking they were buying original BHPC products.

The Delhi High Court has ruled in favor of Lifestyle Equities CV. The court has stated that Amazon’s actions led to trademark infringement and therefore the court:

  • Ordered Amazon to pay ₹340 crore as damages.
  • Banned Amazon from selling or promoting any products using the infringing logo of BHPC.
  • Highlighted Amazon’s business model, where it acted as both a seller and marketplace, making it responsible for such violations.
