All IPR Deadline Extended due to COVID-19

After a thorough review, the CGPDTM has announced that all IPR deadline extended due to COVID-19. 

CGPDTM has declared that the due dates, as for the procedures recommended under the IP Acts, regarding any reply, documentation, and payment of govt fees, and so on in respect of all IP applications falling due from 15th March 2020 to 17th May 2020, will be 1st June 2020

 

Why IPR deadline extended due to COVID-19?

Because of the relaxed norms under the lockdown 4.0, the Indian IP Offices (IPO) in all of the 5 urban areas have continued the greater part of their exercises. However, the IPOs are facing glitches in smooth functioning. Hence, the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) has announced that IPR deadline extended due to COVID-19 

CGPDTM has given an open notification deferring all deadlines related to IPR applications such as trademark registration, copyright registration, and patent registration falling between 15th March 2020 and 17th May 2020 to June 1, 2020.

Lockdown situation

IPR deadline extended due to COVID-19 in India

The CGPDTM has released the notification about IPR deadline extended due to COVID-19 on grounds of the USPTO’s decision to globally extend the IPR deadlines:

 

i. Patent registration deadline extended:

“Notice of Waiver of Patent-Related Deadlines under the sub-rule (6) of Rule 6 of the Patents Rules” dated 20th May 2020. Read notification.

 

ii. Trademark registration deadline extended:

“Notice of Waiver of Trademark registration-related Deadlines under Sec. 131 of the Trade Marks Act, 1999” dated 23rd March 2020. Read notification.

 

iii. Copyright registration deadline extended:

“All hearings relating to copyright matters scheduled from 17.03.2020 to 31.03.2020 have been adjourned”, dated 26th March 2020. Read notification.
