Stepwise Process of Copyright Registration for Literature Work
1. Application Filing of Copyright Registration
An application for Copyright for Literary Work can be submitted by the author or their authorized agent either manually or electronically through the official website. A separate application and a detailed description of the work are required to be submitted to the Registrar for Copyright Registration. An applicant must use the application portal on the organization’s website.
2. Waiting Time
The Registry will wait 30 days from the time the application is received. The purpose of the waiting time is to provide those who have a vested interest in the application/work a chance to raise objections to its registration. After receiving no objections, the application is evaluated.
3. Objection Response if any
In the event that an objection is lodged within the allotted time frame, the parties will be notified in writing and given the chance to respond. The Registrar may issue any of the orders following the hearing to accept or reject the application.
4. Examination
The register may review any copyright application for a literary work that has not been objected to or was Accepted after an objection was filed. The register looks over the paperwork to make sure there are no inconsistencies. Finally, if the registrar discovers any inconsistencies in the application, they will send a “Discrepancy Letter” to the applicant. The applicant has one month from the date of the discrepancy letter’s issue to submit a response.
5. Hearing
After an applicant responds to a Discrepancy Letter, the registrar will issue a Hearing Notice for a hearing to settle the problems. After the Hearing, if all issues have been resolved, the registrar will accept the Application. But if the registrar thinks the problems weren’t fixed, the application will be denied and a Refusal Letter will be sent to the applicant.
6. Successful Registration
Applicants may be asked to provide additional information or documents after they have been accepted by the register. The registrar will enter the applicant’s information into the copyrights register and issue a Certificate of Registration if the information provided is sufficient to support the claim.
