MCA extends Due Date for RoC filing
According to the Companies Act 2013, all companie's are separate legal entities and are directed by certain provisions given of the Act. As per the Company law, all entities are supposed to undergo some legal compliance annually. These are collectively referred to as Annual compliance.
The Ministry of Corporate Affairs, in this context, has given a huge relief to the directors of the companies in India and has recently extended the deadline for RoC filing in the annual compliance of private limited company to December 31, 2018.
#1. Why has the government extended the Due-date for RoC filing?
Recently, the stakeholders were facing continuous and practical difficulties while the process of RoC filing. In the wake of the technical issues faced during e-filing of Form AOC-4 XBRL, the professionals had requested the government to extend the due date for annual compliance of private limited company without levying additional or late annual compliance fee.
Considering the constant requests received from various stakeholders including CA and CS professionals seeking extension of deadline for filing of financial statements for financial year ending 31st March 2018 on account of various technical glitches, Ministry of Corporate Affairs has now relaxed the additional annual compliance fee payable by companies on the e-forms AOC-4, AOC (CFS) AOC-4 XBRL and MGT-7 and has postponed the RoC filing due date up to 31st December 2018.
#2. When did the government extend the RoC filing Due-date earlier?
Previously, the MCA had extended deadline for RoC filing up to 31 December 2018 for companies registered in the State of Kerala. This was done in the view of the severe floods that had affected the state and had caused turbulence in the normal course of business over there.
