All Business Compliance Due Dates Extended due to Coronavirus
We all know that today the world is suffering due to the outbreak of Novel Coronavirus aka COVID-19, which has now become a global pandemic. It has caused widespread economic disruption. In India, the government is compelled to impose a curfew in all 30 states till 31st March 2020, which has disrupted the normal course of business. Resultantly, businessmen are not able to fulfill their compliance within the current time frame.
In order to give them relaxation, the Honorable FM Smt. Nirmala Sitharaman had held a press conference through VC and has announced that all the Business Compliance Due Dates shall now be extended, in the wake of Novel Coronavirus disease.
These extended due-dates have been given below-
#1. Income tax return related due dates
The due dates with respect to the Income-tax return filing and other provisions of Income Tax Act have been extended fo all taxpayers. These are listed below-

The last date for the Income-tax return for FY 2018-19 shall be extended from 31-03-2020 to 30-06-2020.

Interest on delayed payment has been reduced from 12% to 9%

No extension for TDS but for the delayed payment of TDS, interest @ 9% to be charged.

Various other dates of notices, last dates, etc have been moved to 30-06-2020.

AADHAR linking date has been extended to 30-06-2020.

Applicability of Vivad se Vishwas Act 2020 has also been extended to 30-06-2020. From now on to 30-06-2020, there is no charge of 10% at all.

The due date for issue of notice, intimation, notification, approval order, sanction order, filing of the appeal, statements, report, any other document and any other compliance by the taxpayer including investment and rollover benefit for capital gain under IT Act, Benami Act, STT law, Interest Equalization law, Vivad se Vishwas law, it has been extended to 30-06-2020
#2. GST related due dates
The due dates with regard to the Goods & Service Tax Law, including GST return filing, as well as GST registration under composition scheme, have now been extended:-

The last date for filing March, April, May 2020 GST returns and also compensation returns are being extended to 30-06-2020.

Taxable persons which have less than 5cr turnover no interest no late fee no penalty would be charged. Taxable persons having more than 5 cr no late fee no penalty only interest @ 9% will be charged.

The last date for GST registration under the compensation scheme has also been extended to 30-06-2020.

The due date of the GST return filing process shall be extended in a scattered way.
#3. MCA compliance due dates
The compliance laws related to the company incorporation and annual compliance have been relaxed in the wake of COVID-19. Due dates for MCA related compliance have been extended as below-

In respect of the MCA 21 registry, there is a moratorium issue from 1st April till 30th September 2020. There shall not be any additional fee for late filing. Also for holding a Board meeting, the period has been relaxed for the period of 60 days

Applicability of CARO-2020 shall be applicable from FY 2020-21 instead of FY 2019-20.

For the FY 2019-20, if the independent director of the company has not been able to hold even 1 meeting. He shall be not liable.

For newly incorporated companies there is a requirement to file declaration for the commencement of business within 6 months of incorporation, an additional time of 6 months shall be given.

A company director who shall not comply with the minimum residency requirement of 182 days or more under section 149 of Company shall not be treated as violation

There is a requirement of deposit reserve of 20% by April has been shifted to June 2020

The requirement to invest 15% debenture in specified securities maturing during the year that deadlines have been shifted to 30th June 2020.
So these are the major relaxations given to the corporate sector by the government in the wake of Novel Coronavirus Disease.
