Due Date for filing e-Form INC22A (ACTIVE) Extended

Recently, the Ministry of Corporate Affairs had introduced the e-Form INC-22A (ACTIVE) for the companies that were incorporated on or before the 31st December 2017. The due date to file the e-Form INC22A was 25th April 2019.
In case the e-Form INC-22A has not been filed, the company shall be simply marked as “ACTIVE non-compliant”. This will attract a late filing fee of â‚¹10,000/-.
MCA has now extended the due date for filing of the e-Form ACTIVE (INC 22A), from the 25th of April 2019 to 15th June 2019.

#1. What is the significance of Form INC22A (ACTIVE)?

The Form ACTIVE (INC-22A) is an e-Form introduced by the Ministry of Corporate Affairs. This form is for all those companies that were incorporated on or before the 31st of December 2017. ACTIVE is an acronym for Active Company Tagging Identities and Verification. In this form, the companies are required to file all the vital details of the company and the registered office address.

The deadline for filing of e-Form ACTIVE (INC 22A) has now been extended by the Ministry of Corporate Affairs from 25th April 2019 to 15th June 2019.

#2. Why the due date for Form INC22A (ACTIVE) has been extended?

The Ministry of Corporate Affairs has extended the deadline to file e-Form ACTIVE as it has received representations from the Startup community about these new norms for Company incorporation. The Startup entrepreneurs have complained that they have got a very limited time frame to comply with the new procedure of filing e-Form INC22A.

Keeping view of the above issue, the MCA has extended the due date for filing e-Form ACTIVE (INC 22A) to 15th June 2019.

#3. Why did MCA bring e-form INC22A (ACTIVE)?

The MCA had brought the e-Form ACTIVE (INC 22A) for cracking down on the shell companies in order to curb the black money menace.

#4. What are the details required in e-form INC22A (ACTIVE)?

The key details that are required to be furnished along with e-Form INC22A include-

Photographs of the Registered office showing the exterior and interiors of the office building.
Photographs of at least one of the directors.
At least one Director’s KMP who has affixed his DSC (digital sign) with form ACTIVE

The companies that were incorporated on or before the 31st December 2017 are now required to file the e-Form INC22A latest by 15th June 2019.
